Let me start this by saying that I am not a lawyer, nor is this intended to be legal advise. Now that that is out of the way, I have to tell you something that I feel is real valuable to anyone who goes out for a drink. I am talking about the State of Georgia, but in all likelihood this applies nationwide. Ready? You know that machine that A police officer will ask you to blow in on the side of the road? Sure you do. Did you know that that is a VOLUNTARY TEST? Seriously. I have talked to tons of people who thought that it was a “you have to” type of thing. NOPE! It is a tool used by the police to gather more evidence against you for the use of prosecuting you for dui. Here is an added bonus; Road side field sobriety tests are voluntary too. Yes. You can politely decline all of these tests. I would. If I had so much as two drinks, I am turning down all the tests that officer NoRights is going to “offer”. I like how the don’t even ask you. They don’t have to but to just walk up to you and say “I need you to blow in here.” is taking advantage of the lack of knowledge of ones rights that most people have. I tell the officer that my lawyer says that those tests are designed for me to fail and that I will not be participating. (As though he is welcome to proceed without me, haha.) The thing is, you are going to go to jail that night. If you are reading this then you would probably be going to jail after the test anyway, but now they do not have that evidence to hold against you. You will get the whole “if you do not you will lose your license for 12 months” speech, but what they do not tell you is that a lot of cops don’t even fill out that suspension paperwork for one and you have the right to appeal that. (within ten days) Once you have hired a dui lawyer they will know exactly what to do. Most cops DO NOT show up for that appeal hearing, giving you a default, dropping that 12 month suspension. After that, even if they do fill out the paperwork AND show up the the hearing, if you get found not guilty the suspension is null and void. The dui system is designed for Joe Public to fail and tricky to the point where you are confused about your rights. Nothing replaces the advice of a qualified lawyer. The right attorney make all the difference in the world. So think about it. If you do get pulled over, do you KNOW your rights? And if you do, get a dui lawyer as soon as you can.
